These Terms and Conditions constitute a contractual agreement between Papmu and the Visitor or User and describe important information about your rights, obligations and personal information when using our platform.
The Terms and Conditions apply to all the services offered by Papmu, whether on the website www.papmu.com or on any other platform such as mobile app, email, newsletter, etc.
By using or registering to our platform and any related service offered by Papmu, you fully agree to comply with the Terms and Conditions set forth:
www.papmu.com (“Papmu”, “the platform”) is a person to person property platform where:
• Property “Owners” can publish “Ads” in order to sell or rent their “Property” directly to “Visitors” or “Users”, without going through a real estate “Agent/Agency”.
• “Visitors”, and “Users” can communicate directly with each other in order to sell, buy or rent properties outside of this platform.
• “Advertisers” can rent “Advertisement” spaces on our platform in order to benefit from the visibility to promote their products or services.
Papmu solely acts as a property Ad publishing and person to person connecting platform. It is not a real estate Agent/Agency, it does not intervene in the actual real estate transaction, nor does it act as a real estate intermediary between users.

Visitor: any internet user who freely browses or accesses information on our platform in order to contact Owners to rent or buy their property.
User: any Visitor who has voluntarily registered on our platform in order to benefit from the free or paid services offered. Users can be Owners, Landlords, Buyers or Tenants.
Owner: any User who has registered to our platform and who has created or published an Ad in order to sell or rent a property they own. Owners can be individuals or corporate entities and may own one or multiple properties.
Buyer: any Visitor or User who contacts an Owner with the intention to buy their property.
Tenant: any Visitor or User who contacts an Owner with the intention to rent their property.
Agent/Agency: licensed real estate professional or certified real estate broker or realtor who acts as an intermediary between property owners and buyers/tenants in order to negotiate and arrange the buying, selling or rental of a property through a real estate transaction, and usually owns a commission in doing so.
Property: any type of personal or commercial real estate which belongs to a person or a company, such as a house, bungalow, apartment, land, office, commercial space, industrial building, lodge, guest house, etc.
Ad: any property, as defined above, created or published on our platform.
Advertiser: any individual or company who rents an Advertisement space on our platform in order to promote their product or service.
Advertisement: any media published on our platform by an Advertiser in order to benefit from the visibility provided to promote their product or service.
Personal Information or Personal Data: any information which relates to an identified or identifiable individual or company; or different pieces of information, which collected together, can lead to the identification of a particular person or company.
4.1. Services Offered by Papmu
Papmu offers the following services:
• Provision of a digital platform to publish property Ads
• Direct contact and communication between Visitors/Users and property Owners
• Rental of Advertisement spaces
The responsibility of Papmu is strictly limited to the services described in Section 4.1 above.
Papmu is not a real estate Agent/Agency and does not, in any manner whatsoever, get directly involved in the actual property sale or rental transaction, which is exclusively made between the Owner/Landlord and Buyer/Tenant, outside of this platform.
The purchase or rental of a property cannot be made on our platform and is subject to the contract’s terms and conditions discussed and agreed solely between the Owner/Landlord and Buyer/Tenant.
Therefore, in no case shall Papmu be held responsible for any act or consequence related to the actual property sale or rental transaction. It is the sole responsibility of the Owner and Visitor/User to full comply with applicable laws and regulations related to selling, buying and renting property.

4.3. Intellectual Property
Papmu is a registered trademark. All content on this platform (including names, logos, trademarks, illustrations, photographs, images, videos, sounds, software and databases) is copyright material owned by Papmu and Insights Partners Ltd. It is protected by copyright and other intellectual property rights.
Users may download material from this platform for the sole purpose of using the platform correctly.
However, they may not hack, copy, reproduce, modify, transmit, represent, republish, store, send or extract in whole or in part the content or elements constituting this platform without our written consent.
You acknowledge and agree that all images uploaded on our platform including your Profile picture and property related images can be used by Papmu for marketing and promotional purposes through emails, newsletters, as well as on our social media platforms such as Facebook, LinkedIn, Instagram, Twitter, etc.
By using any service offered by Papmu, registering to our platform, publishing Ads or contacting other Users, the Visitor/User agrees to fully comply with all the Terms and Conditions set forth in this document.
If these conditions are not respected, we reserve the right to delete an account or remove Ads at any time and without prior notice. We also reserve the right to retain, as compensation, the full amount paid for the Package, with the option to take further legal action as deemed appropriate.
This platform and any related services offered by Papmu are strictly reserved for individual or corporate property Owners only.
Real estate Agents or Agencies are not allowed to use this platform to post property Ads. They are free to contact Owners if they wish so, and only if the Owner is agreeable.
Likewise, the Owner declares not to be, nor to act directly or indirectly on behalf of a real estate Agent or Agency. Otherwise Papmu reserves the right to delete an account or remove Ads at any time and without prior notice. We also reserve the right to retain, as compensation, the full amount paid for the Package, with the option to take further legal action as deemed appropriate.
Owners/Users can register with Papmu only if they:
– are 18 years old or older
– accept our Terms and Conditions
– are not Agents or Agencies
By registering and creating your Profile on Papmu, you acknowledge that all the information provided by you is accurate, complete, up to date, and does not contain any errors, omissions, misleading or dishonest information.
At any time, Papmu reserves the right to require a proof of identity or any related document to verify the information provided. We also reserve the right to delete any account that may be deemed as inappropriate.
Each registration is for a single User only. Any duplicate account may be removed without prior notice and, in such case, only the oldest account will be kept.
Registered Users agree not to divulge their personal access data (username and password) to a third party and to prevent unauthorized access to their Personal Account.
4.4.4. Obligations and Conduct
The platform is updated regularly and ensures the implementation of state-of-the-art security systems in order to preserve its integrity and data. We strive to make every effort to ensure that this platform is free from viruses, computer bugs and to prevent the use of computer robots.
By using our services, you accept being responsible to ensure that your computer system meets all relevant technical specifications necessary to use this platform and that your computer system is compatible with this platform.
You may not misuse, hack, disrupt the operation or attempt to exploit or copy any information on our platform.
Any link to another platform/website inserted in the information you publish will be verified for adequacy before being approved.

4.4.5. Communicating with Us
Do feel free to communicate with us through the various means provided across our platform. We value your feedback so that we can take action promptly.

4.4.6. Communication between Owners and Visitors/Users
Visitors/Users can communicate directly with Owners outside of the platform through the Contact Form or phone number provided on each individual property page.
Visitors/Users and Owners may also use the onsite Direct Messaging system to communicate directly with each other through the platform.
Real estate Agents or Agencies are not allowed to post property Ads on Papmu. They may contact Owners, only if the latter are agreeable. We reserve the right to delete an account or remove any Ad posted by an Agent or Agency at any time and without prior notice.
Users are required to use the Ad publishing system correctly. We reserve the right to delete any Ad which provides information which is not accurate, complete, up to date, or contains any errors, omissions, misleading or dishonest information or images.
Users agree to the fact that their ads images and information may be used by us for marketing purposes such as posting on our social media platforms, Newsletters, mass emailing, etc.
4.5.1. Posting Ads
Ads must be posted in accordance with the platform best practises. Papmu reserves the right to reject any Ad which does not comply with the following requirements:
a) Ads must be expressed in a correct language, avoiding spelling and grammatical errors.
b) Any Ad showing information or images unrelated to the actual property, such as advertisement, personal opinions, spam, insults, racism, discrimination, harassment, defamation, pornography, child abuse or any other such hateful or harmful message whatsoever will not be tolerated and will be promptly deleted.
c) Owners may indicate a link to another medium for further information on the property published (website, social media page, online brochure, etc) provided that the information strictly relates to the property concerned.
d) The property described in the Ad cannot at any time be substituted by another property.
e) Changes may be made to the property details (description, price, images, contact information), provided that they serve an honest purpose and are not misleading to the Visitors/Users of this platform.
f) Images must be of good quality and respect the minimum dimensions (px) and maximum size (mb).
g) Images must only be related to the property concerned and must not represent people nor be collages of multiple images. Photos from magazines, postcards or tourist or commercial brochures will not be accepted.
4.5.2. Editing Ads
Information and images related to the property may be modified by the Owner, provided that they comply with the above requirements and do no lead to misleading information or abusive behaviour (such as changing the property details, images or price while in process of negotiating with the User).
4.5.3. Approval of Ads
All Ads submitted are subject to a strict verification by our Customer Service before being approved and published.
Any Ad which does not comply with Sections 4.5.1 and 4.5.2 above shall not be approved and may be promptly removed without prior notice.
All Ads are automatically translated and published into 2 languages: English and French. If you have created an Ad in English, you can see and edit the French version of your Ad on the French version of the site in the My Properties section in your Dashboard, and vice versa.
In order to optimize the visibility of your Ad, Papmu strongly recommends that you verify and adjust the translated version of your Ad.
4.6. Packages & Payments
Posting an Ad requires that the User has subscribed to a Package, whether paid or free.
The full amount of the selected Package must be paid in advance by using one of the secured payment methods offered.
Packages can be changed at any time and renewed upon expiry.
The number of Ads/Boosted Ads, visibility period and price are clearly indicated in the description of the various Packages offered on the Pricing and My Package pages.
Ads are visible immediately after the payment has been confirmed and only after the Ad has been approved. They remain visible as per the conditions set in the Package and as long as the Package has not expired.
We reserve the right to change the conditions and prices of our Packages at any time and without prior written notice.
4.7. Cancellation and Refund
All our services are sold “as is”. You assume the responsibility for your purchase, and no Package cancellation nor refund will be granted, unless due to technical reasons from our part.
Once your payment has been made, it will not be refunded in case you decide to delete or unpublish your Ad.
We may consider exceptional situations on a case by case basis.
4.8. Deleting Ads And User Exclusion
Papmu reserves the right to delete any Ad which does not comply with the publication requirements as defined in Section 4.5.
Papmu reserves the right to temporarily or definitively delete User Accounts or exclude Users from the platform in case they do not comply with the requirements set in these Terms & Conditions.
The excluded user will no longer attempt to access the platform under another identity or through another User.
Papmu reserves the right to publish Advertisements or promotional messages on any page of this platform.
Advertisement spaces are rented to companies or individuals other than Agents/Agencies. The conditions are agreed outside of this platform between the Advertiser and Papmu.
Advertisements contain links to external platforms operated by third parties. You acknowledge that Papmu does not accept any responsibility for the contents, promotions, products or services advertised by the third party, which are governed by their own terms and conditions of use.
Papmu is not responsible for any transactions made between the Visitor/User and Advertisers.
4.10. Contractual Commitment
The Terms and Conditions herein constitute a contractual agreement between Papmu and the Visitor or User.
Upon visiting or using this platform, the Visitor or User agrees to accept all terms of this contract.
If ever the competent authorities decide that a part of the general terms and conditions should lapse, only the part concerned will be affected and no change will be made to the rest of conditions.
Papmu reserves the right to update the contents of the platform as well as its Terms and Conditions at any given time.
The updated Terms and Conditions apply with immediate effect. We therefore invite Users to regularly review our Terms and Conditions in order to remain compliant with requirements.
4.12. Applicable Law And Jurisdiction
Our Terms and Conditions are subject to Mauritian laws and regulations.
In case of a dispute relating to our Terms and Conditions which could not be settled through a mutual agreement between parties, the Court of Mauritius will be designated as competent.
It complies with the EU General Data Protection Regulations (GDPR) and applies to any service offered by Papmu, whether on this website or on any other platform such as mobile app, emails, newsletters, etc.
Your personal information will not be sold, traded or transferred for any reason to any company or third party other than Insights Partners Ltd without your consent. However, this excludes trusted third parties who help us operate our platform or conduct our business, as long as these parties agree to keep this information confidential.

5.3. What personal data we collect
Papmu collects the following personal information:
• Visitors: IP address, language, email address (in case of subscription to our newsletter)
• Users: user name, first name, last name, email address, telephone, profile picture, IP address, language, property details (description, price, media, contact details)
Contact Forms and Direct Messaging System
Depending on the Contact Form or Direct Messaging system that you use, the following information is collected: name, username, email, phone, company, website, url, page visited, property concerned, message posted.
All uploaded media are publicly accessible. If you upload files to the platform, you should avoid uploading images with embedded location data (EXIF GPS) included.
Visitors of the platform can download and extract any location data from images on the platform.
When you purchase a Package with us though our secure online payment service, we collect your name, payment information and related personal information required to complete the purchase.
Payment information is verified with payment processors and some data from the transaction is stored by the payment processor.
This platform provides a chat tool which connects Visitors and Users to our Customer Service department in order to respond to queries and assist where necessary.
We collect information related to your name, email address, phone number and message in order to start the chat.
This information may be stored within the chat application for follow up and marketing purposes. For more information, please refer to section 5.8.
Comments and Reviews
In case you are offered the opportunity to comment or review information posted on our platform, we collect your username, email and the contents of your comment or review.
When you use our platform, we collect tracking information for statistical purposes.
This includes, amongst others: your browser type and language, the type of operating system you use, the name of your internet service provider, the searches you have made, the pages and property Ads you have visited, etc.

Newsletters, Email Marketing and Sharing
We collect your email address if you opt-in to our Newsletter. This email address will be used to send you Newsletters as well as special offers or promotions related to your interests.
If you use our sharing feature, we collect information on the page (url and description) you are visiting so that it can be shared upon your request with third parties such as Facebook, Whatsapp, Email, SMS.

Surveys & Contests
We may from time to time launch surveys and contests in order to have your feedback on our services. In such case your name, email and answers will be collected by us.
5.4. How we collect personal information
We collect your personal information in the following ways:
• When you provide it to us voluntarily on our platform when registering and creating an account, purchasing a Package, submitting a property, communicating with us or other Users, chatting with us, subscribing to our Newsletter or sharing information.
• Automatically as you navigate through our platform in order to improve user experience or for statistical purposes.
• Automatically through our service providers for marketing or statistical purposes.
5.5. How we use your personal data
We use your personal information for the following purposes:
– Manage your account and data (property Ads, Packages, Invoices, Messages, etc)
– Conduct appropriate validations for approval before publishing your properties
– Help us improve your user experience and provide a personalized service to you
– Send you marketing communications, surveys, newsletters and inform you about new offers, products and services that may interest you
– Use your ads images and information for marketing purposes such as posting them on our social media platforms, Newsletters, mass emailing, etc
– Use statistical data to engage in market research which is relevant for maintaining our customer relationship with you
You can at any time ask us or third parties to stop sending you marketing communications by opting out of such communications or by contacting us.
Please note that by opting out of receiving marketing communications, this does not apply to the personal data that you have provided as a result of other actions such as registration, purchasing, communicating directly with other us or Users, etc.
5.6. How long we retain your data
Your personal profile information as well as any property related information is maintained for as long as they are retained by you within your account.
Any information generated by cookies is retained anywhere between a few hours, to days, weeks or months as per the cookie settings for proper site functioning as described in section 5.10 below.
5.7. Where we store/transfer your personal information and how we keep it secure
The personal information which we store or transmit is protected by security and access controls, including username and password authentication and data encryption.
Your personal information is stored on secured servers managed by our hosting company.
Papmu uses an SSL secured encryption protocol to encrypt and secure all data processed or transmitted through our platform to our service providers.
5.8. Who we share your data with
Once your property Ad is published, Papmu shares your username, phone number and all property related information (price, description, media, links, contact details) publicly so that Visitors and Users can access it and contact you as necessary.
Information that you post through Owner Contact Forms or the Direct Messaging system is shared with the Visitor or User you are communicating with.

5.9. Advertisement and Third-Party Links
Papmu sells Advertising spaces which include links to third-party platforms and applications. By clicking on those links or enabling connection to these applications, you may allow third parties to collect or share your data.
A cookie is a small text file saved on your computer or mobile device by the website you are browsing. Cookies are used to save and track data in order to identify your settings and preferences so that the platform functions correctly, or to better offer services tailor made to your needs or generate usage statistics.
Our platform uses functional, technical and third-party cookies for the following purposes:
• Store your settings and preferences to ensure a correct functioning of the platform and enhance user experience: login details, profile details, properties, browser language, pages visited, saved searches, favourites, direct messages, etc.
• Store temporary information such as property urls and details in order for you to share it through our platform or chat with us.
• Collect information on your navigation on our platform in order to generate statistics which help us improve the services we provide to you.
By continuing to use our platform, you accept the current settings of our cookies and acknowledge to understand the terms of our policy on cookies.
5.11. What rights you have over your data
Visitors and Users of our platform have the following rights:

You can also request that we erase any personal data we hold about you or ask for the closure of your account you have with us at any time by contacting us.
This does not include any data we are obliged to keep for administrative, legal, or security purposes.
5.12. How you can access or change your personal information
You can access the personal information related to your profile, properties, packages, purchases or direct messages by logging in to your account.
You can see, edit or delete your personal information at any time, except for you username. Website administrators can also see and edit that information.
You have the right to request access to further personal information that we hold about you and to request corrections of any errors in that data.
You can also delete your account at any time.

All the information on this platform is published in good faith and is subject to change without notice. It should not be relied upon as a substitute for legal, financial, real estate or other expert advice.
The tools provided on this platform such as the Loan Simulator, Currency Converter, Sample Contracts or Advice are for informational purposes only. They are only intended to provide a rough estimate or guidance and cannot be guaranteed as exact.
Papmu disclaims all liability for the accuracy of the information provided by the tools and invites the Visitors and Users to use them with discernment and confirm accuracy with relevant parties concerned.
6.2. Limit of Warranty and Liability
Any information indicated on the property Ads hosted by Papmu (description, photos, price, contact details, links, etc) are solely for information purposes. They are provided by the property Owner and may be subject to modifications without notice.
Papmu is not responsible for the property details (description, photos, price, contact details, links, etc) fixed by Owners and displayed on the platform.
Papmu cannot guarantee the accuracy or suitability of the information provided by Owners and cannot be held responsible if this information has errors or is incomplete, inaccurate, changed or misleading. Papmu disclaims all liability in case of errors, misinterpretations or any misuse of property Ads.
Although great care has been taken to ensure the accuracy of all information, the platform may contain inaccuracies and non-available products, for which Papmu shall not be liable.
The purchase or rental of a property cannot be made online and is be subject to the real estate Contract terms and conditions discussed between the Owner and Buyer/Tenant. In no case shall Papmu be held liable for any condition or consequence arising from the actual agreement and/or Contract made between the Owner and Buyer/Tenant.
While every effort is made to ensure that your Ad is published immediately after approval and as long as your Package is valid, we do not guarantee that posting your Ad will lead to an actual deal.
Papmu does not warrant that your access to or the running of this platform will be uninterrupted or error free due to circumstances beyond our reasonable control such as loss of power, breakdown, malfunctioning of your computer or software or internet errors or unavailability.
We do not accept any liability if we cannot process your data, or if your data is lost, incorrect or incomplete due to circumstances beyond our reasonable control such as loss of power, breakdown, malfunctioning of your computer or software or internet errors or unavailability. Data includes, but is not limited to: your profile details, contact information, password, account ID, property details, price, media, communication, etc.
Whilst we endeavour to ensure that any material available for downloading from this platform is not contaminated in any way, we do not warrant that such material will be free from contamination, viruses, bugs, and/or similar code.
This platform contains links to external platforms/websites other than Papmu and which are operated by third parties. While we strive to provide only quality links to useful and ethical platforms, we have no control over the content and nature of these sites. The content of such sites may change without notice and may occur before we have the opportunity to remove a link which may have gone ‘bad’.
We do not form any opinion or recommendation for any of the content found on these third party sites, nor do we make any warranties or representations as to the accuracy or completeness of any of the information appearing in relation to any linked platform/website. This includes any links provided by Owners as well as any promotion, product or service provided by Advertisers accessed through our platform.
Papmu accepts no liability for any direct, indirect or consequential loss, damage, corruption, cost or expense of any type related to the use of our platform or reliance on any information provided on it. This may include, but is not limited to: data, media, profit, business, reputation, security, etc.
Papmu offers several means of direct communication between Visitors or Users. We do not accept any liability for any consequence, loss, damage, misuse or abuse arising from the communication that you exchange directly with the Visitors or Users of this platform.
For the purpose of the proper functioning of our services, Owners agree that their username and phone number will be displayed publicly on our platform. Papmu shall not be liable for any consequence, loss, damage, misuse or abuse arising from the use of such information by the Visitors or Users of this platform.
